The terms for using this website.
These Terms of Service set out the rules for using the Accelerate Tech website. They're written to be readable rather than comprehensive - if anything is unclear, get in touch. Our paid engagements are governed by separate agreements.
1. Acceptance of these terms
By accessing or using the Accelerate Tech website and the materials made available through it ("Website"), you agree to these Terms of Service. If you don't agree, please don't use the Website.
2. Use of the Website
You may use the Website for lawful, personal and business purposes. You agree not to:
- Use the Website in any way that breaches an applicable law or regulation
- Attempt to gain unauthorised access to any part of the Website or its underlying systems
- Probe, scan or test the vulnerability of the Website without prior written permission
- Reproduce, duplicate, copy, sell or resell content from the Website without permission
- Submit any content that is defamatory, infringing, or contains malicious code
3. Intellectual property
All content on this Website - including text, graphics, logos, images, downloadable materials, source code and the underlying compilation of all of the above - is owned by or licensed to Accelerate Tech and is protected by Australian and international copyright and trade mark laws.
You may print, download or share content for personal or internal business reference, provided you keep all copyright and other proprietary notices intact. Any other use requires our prior written consent.
4. Third-party content and links
The Website may include references to or links to third-party content, products or services. We are not responsible for the content, availability or practices of those third parties. Reference to a third party does not imply endorsement.
5. No professional advice
Material on the Website - including blogs, articles, case studies and downloadable guides - is provided for general information only. It is not legal, financial or professional advice. You should obtain advice tailored to your circumstances before acting on anything you read here.
6. Disclaimers and warranties
We make reasonable efforts to keep the Website accurate and available, but we provide it on an "as is" basis. To the fullest extent permitted by law, we exclude all representations and warranties about the Website's accuracy, completeness, fitness for purpose, or freedom from defects or interruption.
Nothing in these Terms excludes any consumer guarantee under the Australian Consumer Law that cannot lawfully be excluded.
7. Limitation of liability
To the maximum extent permitted by law, Accelerate Tech is not liable for any indirect, incidental, consequential or special loss or damage arising out of your use of, or inability to use, the Website.
Where our liability cannot lawfully be excluded but can be limited, our liability is limited at our option to: (a) re-supplying the relevant content or service; or (b) paying the cost of having that content or service re-supplied.
8. Client engagements
Use of the Website does not create a client relationship. Our services are provided under separately negotiated engagement letters or master services agreements. In the event of any inconsistency, the engagement-specific terms prevail over these Terms.
9. Changes to these terms
We may update these Terms from time to time. The "Last updated" date at the top shows when they were last revised. Continued use of the Website after a change means you accept the updated Terms.
10. Governing law
These Terms are governed by the laws of New South Wales, Australia. You and Accelerate Tech submit to the exclusive jurisdiction of the courts of New South Wales for any dispute connected with these Terms or the Website.
